Your First Ride LLC. / Rev'it up Rentals Motorcycle Rental and Touring Company
Release of Liability Waiver:
This Release of Liability Waiver (the "Waiver") is executed on this ___ day of _______, 24, by the undersigned individual (hereinafter referred to as "Rider") in favor of Your First Ride LLC / Rev"it Motorcycle Rental and Touring Company, its directors, officers, employees, agents, affiliates, successors, and assigns (collectively referred to as "Company").
1. Acknowledgment of Risk: The Rider acknowledges and understands, that participating in motorcycle riding, whether through rental or guided tours, involves inherent risks, including but not limited to the risk of serious injury, permanent disability, or death. The Rider acknowledges that these risks may result from their own actions or inactions, the actions or inactions of others, or the condition of the motorcycle and equipment provided by the Company.
2. Assumption of Risk: The Rider voluntarily and freely assumes all risks associated with motorcycle riding, including but not limited to road conditions, weather conditions, mechanical failure, and accidents. The "Rider" agrees that they are solely responsible for their own safety and the safety of others while participating in activities provided by the Company.
3. Release and Waiver: In consideration of being permitted to rent and/or participate in motorcycle tours provided by the Company, the Rider, on behalf of themselves, their heirs, personal representatives, and assigns, hereby releases, waives, and discharges the Company: from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, or death that may be sustained by the Rider, whether caused by the negligence of the Company or otherwise, while participating in activities provided by the Company.
4. Indemnification: The Rider agrees to indemnify and hold harmless the Company from any and all claims, demands, actions, or causes of action, including attorneys' fees and costs, arising out of or related to any loss, damage, injury, or death sustained by the Rider or others as a result of the Rider's participation in activities provided by the Company.
5. Compliance with Laws and Regulations: :
"The Rider" agrees to comply with all local, state, and federal laws and regulations while participating in activities provided by the Company, including but not limited to those related to motorcycle operation and safety.
6. Condition of Equipment: The Rider acknowledges that they have inspected the motorcycle, and any related equipment provided by the Company and found them to be in good working condition. The Rider agrees to notify the Company immediately of any defects or issues with the motorcycle or equipment during the rental or tour period.
7. Safety Gear: The Rider acknowledges that they are required to wear proper safety gear, including but not limited to a helmet, over-the-ankle shoes, gloves, jacket, and long pants, while participating in activities provided by the Company. The Rider understands that limited safety equipment may be available for rental or purchase from the Company, but it is their responsibility to ensure they have and use the appropriate gear.
8. No Warranties: The Company makes no warranties, express or implied, regarding the safety or condition of the motorcycles and equipment provided. The Rider accepts the motorcycle and equipment "as is."
9. Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of laws principles.
10. Severability: If any provision of this Waiver is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
11. Entire Agreement: This Waiver constitutes the entire agreement between the Rider and the Company and supersedes all prior understandings or agreements, whether written or oral, regarding the subject matter of this Waiver.
By signing below, the Rider acknowledges that they have read, understood, and agreed to the terms and conditions of this Release of Liability Waiver.
